1. Who We Are and What These Terms Cover

These Terms of Service ("Terms") govern your access to and use of:

  • the Bionutara mobile application (the "App");
  • the website located at bionutara.fr (the "Website"); and
  • any related services, features, content, subscriptions, and support channels we provide (together, the "Service").

The Service is operated by BLUEPINKSECURITY LTD ("BluePinkSecurity", "Bionutara", "we", "us", "our").

If you do not agree to these Terms, do not use the Service.

2. Important Notice: Bionutara Is Not Medical Care

IMPORTANT NOTICE

Bionutara is a wellness companion designed to support reflection, routine, and wellbeing. It is not medical care. We do not diagnose, treat, cure, or prevent any disease or medical condition.

The Service:

  • does not replace medical advice or care;
  • is not a substitute for a doctor, pharmacist, psychologist, midwife, therapist, or any licensed healthcare professional;
  • may provide general, educational, or wellbeing-oriented information, but that information may not be appropriate for your individual situation.

If you think you may have a medical emergency, seek immediate help through local emergency services.

3. Acceptance of These Terms

By using the Service, you confirm that:

  • you have read and understood these Terms; and
  • you agree to be bound by them.

4. Changes to These Terms

We may update these Terms to reflect changes to the Service, legal obligations, or operational requirements. When we make material changes, we will provide notice through the App, Website, or other reasonable means.

5. Eligibility

You must be at least 18 years old to use the Service.

6. Your Account

You may need an account to access the Service. You agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login details.

7. The Service and Optional Features

The Service may include features such as wellness prompts, guidance, Profile Brief, optional voice features, and device capabilities such as camera, microphone, photos, and location.

8. Subscriptions, Free Trial, Billing

8.1 Subscription Model

Bionutara is offered on a subscription basis:

  • 7-day free trial, then
  • €50 per month (VAT excluded; VAT may apply where applicable)
  • Payments are managed via RevenueCat and processed by secure third-party payment providers (such as Stripe for web subscriptions, or Apple App Store / Google Play where applicable).

8.2 Free Trial

If offered, the free trial gives access to subscription features for the trial period. Unless you cancel before the trial ends, your subscription will automatically convert into a paid subscription.

8.3 Automatic Renewal

Subscriptions automatically renew unless cancelled before the end of the current billing period.

8.4 How to Cancel

You may cancel at any time through your Apple ID / App Store subscriptions settings, Google Play subscriptions settings, or your account settings on our website for web subscriptions.

8.5 No Refunds

All sales are final. We do not offer refunds except where mandatory under applicable law.

9. Acceptable Use

You agree to use the Service responsibly and lawfully. You must not misuse the Service, attempt unauthorized access, or interfere with security features.

10. User Content

You are responsible for content you submit. You must not submit content that infringes rights or is unlawful.

11. Feedback

If you provide feedback, you grant us a perpetual, royalty-free right to use it.

12. Intellectual Property

We own all rights in the App, Website, and content we provide. We grant you a personal, limited license to use the Service.

13. Third-Party Services

The Service may integrate with third-party services. Your use of third-party services is governed by their terms.

14. Disclaimer of Warranties

The Service is provided "as is" without warranties. We do not guarantee outcomes or improvements to wellbeing.

15. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid in the 12 months before the event giving rise to the claim.

16. Termination

You can stop using the Service at any time. We may suspend or terminate access if you breach these Terms.

17. Privacy

Our processing of personal data is described in our Privacy Policy.

18. Governing Law

These Terms are governed by the laws of England and Wales.
