Legal Basis & GDPR Compliance
Bionutara collects and processes your personal data in accordance with the GDPR (EU General Data Protection Regulation), French law, and the CNIL’s guidance. All processing is based on your consent or contractual necessity, strictly for the provision of services.
Data Rights
You may request access, correction, export, or deletion of your personal data at any time via dpo@bionutara.fr. You have the right to object to or restrict processing in accordance with applicable law.
Data Transfers & Processors
Where personal data is processed outside the EU, all transfers are subject to appropriate safeguards (e.g. Standard Contractual Clauses, adequacy decisions). We only use service providers who guarantee GDPR-level protection and we inform you of any material change.
Complaints & CNIL
Should you believe your data rights have not been respected, you may contact the CNIL (Commission Nationale de l'Informatique et des Libertés, www.cnil.fr).
No Medical Advice
Bionutara provides wellness and informational content only. Our tools are not a substitute for medical advice or treatment. Always consult a qualified professional for healthcare needs.
Service Availability
We strive for high availability, but do not guarantee that services will be uninterrupted or error-free. Bionutara is provided “as is” and “as available.”
Liability Limits
To the maximum extent permitted by law, Bionutara, its officers, and employees disclaim all liability for indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, profits, use, or goodwill. Nothing in these Terms excludes or limits our liability for bodily harm, death, or fraud, or for any other liability that cannot legally be excluded.
Mandatory Rights
Nothing in these Terms restricts your mandatory consumer rights under applicable law. These Terms do not affect your statutory rights as a consumer.
Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control (e.g. natural disasters, war, regulatory changes).
External Integrations
Bionutara may provide links or integration to external services or APIs (e.g. Apple Health, WhatsApp). We are not responsible for the content, policies, or practices of such platforms. You use them at your discretion and must accept their terms.
By using Bionutara, you agree not to post or transmit any content that is illegal, offensive, defamatory, abusive, harmful, or infringing on intellectual property rights. Breaches may result in suspension, deletion of your account, or legal action.
Applicable Law
These Terms are governed by French law and relevant EU regulations (including the French Consumer Code and GDPR). In case of any divergence between the French and English versions, the French text shall prevail.
Disputes
Any dispute relating to these Terms will be submitted to the competent courts of Paris (France), except where mandatory legal provisions specify otherwise.
Consumer Protection
If you are a consumer in the EU, nothing in these Terms waives your mandatory consumer rights or access to your relevant local ombudsman or mediation service.
Severability
If any clause of these Terms is declared invalid or unenforceable, the other clauses remain in full force. Any necessary modification will be limited to what is strictly required.
Changes to Terms
We may update or revise these Terms. Changes will be announced on this page and/or by email. Your continued use after modification constitutes your acceptance of the new Terms.
